1/1/2012 DATIA and SHRM Poll Show Pre-Employment Drug Testing On the Rise!!
The Society for Human Resource Management (SHRM) and the Drug and Alcohol Testing Industry Association (DATIA) released a poll this fall that showed the practice of requiring job applicants to take a pre-employment drug test appears to be gaining acceptance from employers. The September 7, 2011 poll revealed that fifty-seven percent of the survey participants’ organizations require all job candidates to take a pre-employment drug test, while less than a third (29 percent) do not have a pre-employment drug-testing requirement. The remaining 14 percent of respondents test applicants for safety-sensitive positions and when required by state law. The U.S. Department of Transportation recently celebrated the 20th anniversary of the statutory authority to conduct drug and alcohol testing for workers entrusted with the safe operation of our nation’s transportation system. The Omnibus Transportation Employee Testing Act, signed into law on Oct. 28, 1991, was enacted to reduce the abuse of alcohol and illegal use of drugs by employees such as pilots, airline mechanics, railroad engineers, truck drivers, bus drivers and subway operators. Since the law was implemented, illegal drug use among transportation workers has dropped 50 percent, while the risk of fatal accidents caused by alcohol use by truck and bus drivers has dropped 23 percent.
The United States Drug Enforcement Administration (DEA) exercised its emergency scheduling authority to control five chemicals(JWH-018, JWH-073, JWH-200, CP-47,497, and cannabicyclohexanol) used to make so-called "fake pot" products. Except as authorized by law, this action makes possessing and selling these chemicals or the products that contain them illegal in the United States. This emergency action was necessary to prevent an imminent threat to public health and safety. The U.S. Drug Enforcement Administration also issued a one-year ban on possessing and selling three chemicals commonly used to produce bath salts. Bath salts can cause chest pains, increased blood pressure, a racing heartbeat, agitation, hallucinations, paranoia and delusions, according to the Office of National Drug Control Policy. Overdoses can be fatal and are difficult to prevent because the strength of the stimulant can vary by brand and even by batch. The stimulant, offered as a fine white or off-white powder, is labeled “not for human consumption” and sold under brand names including Ivory Wave, Blue Silk, White Dove or Ocean Burst.

The Department of Health and Human Services (HHS) is changing the effective date of the Revisions to the Mandatory Guidelines for Federal Workplace Drug Testing Programs (Mandatory Guidelines) from May 1, 2010, to October 1, 2010. The purpose of this notice is to notify participants in Federal and federally-regulated workplace drug testing programs as soon as possible that they will not be expected to implement the revisions to the Mandatory Guidelines on May 1, 2010, so that they do not unnecessarily expend resources to comply on May 1, or risk compliance problems by prematurely implementing new provisions.
